Terms of Service

Kivviq reads your Shopify store and the marketing accounts you connect, and shows you analysis of them. It is read-only on your store: it holds no write permission and cannot change an order, a product or a price.

Your data stays yours. We do not sell it, share it between merchants, or train AI models on it — see the Privacy Policy.

The AI analysis is generated from your own data and can be wrong. It is not financial, legal or professional advice.

1. This agreement

These terms govern your use of Kivviq, an analytics application for Shopify merchants. Kivviq is operated by Maison Olive ("we", "us"), and these terms form an agreement between Maison Olive and the business that installs or signs in to Kivviq ("you", "the merchant").

Installing the app, connecting a data source, or signing in to the dashboard means you accept these terms. If you do not accept them, do not install the app.

Our Privacy Policy describes what data Kivviq processes and why, and forms part of this agreement.

2. What the service does

Kivviq reads data from the accounts you connect — your Shopify store, and where supported your advertising and email platforms — and presents analysis of it: dashboards, metrics, cohort and attribution reporting, and answers from an AI analyst.

Kivviq is read-only with respect to your store. It requests no write permission on Shopify. It cannot create, change, cancel or refund an order, alter a product or a price, or contact your customers.

Which data sources a given account can connect depends on what the product supports at the time. Shopify is self-service. Other sources may require configuration by us, and some may not be available to your account at all.

3. Accounts and access

A Kivviq workspace is created when a merchant installs the app, and the first person to complete sign-in becomes its owner. Owners and administrators can invite and remove other members. You are responsible for who you grant access to and for what they do with it.

Sign-in uses a Google account. You must keep that account secure; we treat anyone who completes a valid sign-in as authorised by you.

You may disconnect any data source, or remove a member, at any time from within the product.

4. Your data

Your data remains yours. We process it to provide the service to you and for no other purpose. We do not sell it, do not share one merchant's data with another, and do not use your data or your customers' data to train AI models.

You grant us the permission needed to do that processing — to read from the accounts you connect, store the results, and display and analyse them for you — for as long as your account exists.

Where Kivviq processes personal data about your customers, it does so as your processor and on your instructions. The Privacy Policy sets out exactly which fields those are.

5. Acceptable use

You agree not to:

  • connect an account you are not authorised to connect;
  • attempt to access another merchant's workspace or data;
  • probe, scan or interfere with the service's security or availability;
  • use the service to process data unlawfully, or in breach of your obligations to your own customers;
  • resell or redistribute the service or its output as your own product; or
  • use automated means to extract data from the service at a volume that degrades it for others.

We may suspend access without notice where we reasonably believe it is necessary to protect the service, other merchants, or someone's data.

6. AI-generated analysis

Part of Kivviq produces written analysis using a large language model. That analysis is generated from your own data, but it is not advice and it can be wrong. Figures are drawn from your connected sources and are only as complete and current as those sources are.

You are responsible for decisions you make using the product. Do not treat its output as financial, legal, tax or professional advice.

Where a figure cannot be verified, the product is designed to say so rather than present an estimate as a measurement. If you see it doing otherwise, tell us — that is a defect.

7. Third-party services

Kivviq depends on services operated by others — Shopify, and the analytics, advertising and email platforms you connect, along with our hosting and infrastructure providers. Those services have their own terms, and their availability and behaviour are outside our control.

If a provider changes its API, revokes an authorisation, rate-limits us or goes down, parts of Kivviq will be unavailable or incomplete until it recovers. Where that happens the product is designed to report the gap rather than fill it with an estimate.

8. Fees

Any fees, the billing period, and the payment method applicable to your account are those agreed with you in writing or presented to you at the time of purchase. Kivviq does not currently charge through Shopify's billing system; no charge is raised against your Shopify account by this app.

Fees are exclusive of applicable sales taxes, which are added where we are required to collect them. If we change the fees for your account, we will tell you in advance, and the change takes effect from your next billing period.

9. Availability

We aim to keep Kivviq available and working, but we do not offer a service level commitment. The service is provided on an "as is" and "as available" basis. We may change, add or withdraw features, and we may take the service down for maintenance.

We will give reasonable notice of a change that materially reduces functionality you rely on, where it is within our control to do so.

10. Ending this agreement

You may stop using Kivviq at any time by uninstalling it from your Shopify admin and disconnecting any other sources.

Uninstalling is not the same as deleting your data. Uninstalling revokes our access to your store and we destroy the stored credentials; your account and its history are kept so that a reinstall restores them. Shopify sends us a redaction request 48 hours after an uninstall, at which point we erase your store's Shopify data. To have your whole Kivviq account erased, write to privacy@kivviq.ca. Section 10 of the Privacy Policy sets out precisely what each of those removes.

We may end this agreement on reasonable notice, or immediately where you have breached section 5.

11. Liability

To the extent permitted by law, neither party is liable to the other for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill, data or anticipated savings, however caused.

Our total aggregate liability arising out of or in connection with this agreement is limited to the total fees you paid to Kivviq in the twelve (12) months preceding the event giving rise to the claim.

Nothing in this agreement limits or excludes liability that cannot lawfully be limited or excluded, including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under any consumer-protection legislation that applies to you and overrides these terms.

12. Changes to these terms

We may update these terms. The revision date at the top of this page changes when we do, and we will tell connected merchants directly about a change that materially affects their rights. Continuing to use Kivviq after a change takes effect means you accept it.

13. Governing law

This agreement is governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to their conflict-of-laws rules.

Any dispute arising out of or in connection with this agreement is subject to the exclusive jurisdiction of the courts of the Province of Quebec, and each party submits to that jurisdiction. Nothing in this section removes a right you may have under the law of your own place of business to bring proceedings there, where that right cannot be contracted out of.
